The Introduction

After the fully confirmed from the renter for his/her eligibility for sign a contract he/she sort a deal with the company name which mentioned in the letter head to rent the car which it details mentioned in the previous slots and that for the rent value which will be decided by the company and I accept and confirm all the articles and the terms and condition which will be in this contract and the attachments and am fully committed with it and fully committed with the UAE traffic laws and rent cars rules, and I agreed to follow the UAE criminal law and never use the rented car to do anything against UAE laws and rules, In the event of this, I prepared to assume full criminal and civil liability and to compensate the company for the damage caused to it in both property and business transactions.

1. The introduction is a basic part of this contract.

RECEIVING, RETURNING BACK AND THE USING OF THE CAR

2. The renter must go to the company's pre-determined branch to receive the vehicle which agreed to lease and also be committed to return it to the same branch on the day and hour specified for the return of the vehicle, otherwise a fine will be charged.
3. The car will not be off hire from the renter after the company's official opening hours Sunday to Thursday from 9am to 5pm and Friday and Saturday from 9am to 1pm an additional 350 dirhams will be charged for returning after these timings.
4. The renter checks the vehicle thoroughly before it is received and acknowledges that it is in good, clean and usable condition.
5. Renter should return the car completely clean and free of any belongings or concerns, cleaning up must be a maximum of 3 hours before the vehicle delivering and cleaning the car at a washing station at a official petrol station for example (ADNOC, Emirates..Enoc.Eppco. only.). or Aed 350 dirhams will be charged.
6. The renter must not leave any items or personal stuff in the vehicle upon delivery and the company will not be responsible for the loss or loss of any items on the vehicle when delivered.
7. The renter should not take, replace, alter the features or shape of the vehicle, or glued, add a pulmonary, change the color of the vehicle, remove the number plates, or otherwise expose any part of the vehicle.
8. The renter is obliged to keep the vehicle in all possible ways from the moment the vehicle is picked up and delivered again to the company in good and safe condition.
9. From the moment the renter receives the vehicle until delivery, the renter is liable and the renter responsibility and the company has no responsibility for the renter behavior by car during the rent period.
10. The Company have the fully right to give any data about the renter or the vehicle's location to any government authorities in the UAE if it requested and the renter shall not be entitled to sue, return legally or seek compensation from the Company for this.
11. The Company has the right to disconnect and stop the vehicle at any time it wishes without returning to the renter, notifying or informing the renter.
12. Hirer is allowed to use 67 KMs per day only and additional will be charged for any extra KM as per the vehicle category mentioned below.
13. In the event that the vehicle fails or stops working, the renter must contact the company directly and report the fault and not attempt to repair it himself.
14. If the vehicle is not working as a result of a traffic accident, the renter must call directly the police and the company, to report about the accident, its location, and not drive or move the vehicle until the company representative arrives in case of any delay or non-contact Car must be brought to return location on recovery.
15. The renter must use the vehicle by himself, drive it by himself, and do not lend it to anyone else who is not mentioned in the contract Insurance is not applicable in case of other person driving car.
16. If the renter lends the car to another person, he or she will be fully responsible for his or her actions, driving, and all that the other person doing or doing by the vehicle.
17. In the event of an accident when the non-renter drives the vehicle, the renter will bear all the consequences of the accident, which explain in the accident and violation section of this contract and pay compensation to the company in the amount of 10,000 AED.
18. The renter must return the vehicle and the fuel tank with at least 25% filled.
19. If the duration of rent exceeds 21 days, the renter must come directly After that time to the company, for the technical inspection and routine maintenance of the vehicle and, if He did not attend on time so a fine will be imposed Weekly plus responsible for any damage caused to the vehicle by non-maintenance, and bears all expenses from spare parts, maintenance, garage costs and any other expenses resulting from non-compliance with that article.

FINES AND TRAFFIC ACCIDENTS

20. Renter Takes Full responsibility (Civil and Criminal) of the vehicle and his behavior as per UAE law during the rent period.
21. All traffic of fines, administrative charges and taxes added during the rent period shall be borne by the renter and pay it full to the company.
22. If the non-renter drives the vehicle and leads it for any traffic violations, the renter will bear all the same responsibility as described in the previous article without any liability on the Company.
23. The renter is not allowed to use the vehicle on an off-road except with the prior written permission from the company or a fine of AED 15,000 + any repair cost will be imposed by the company.
24. The extent to renter to uses the car is within U.A.E.

VIP SERVICE

25. Car PICK UP Service for renter costs 350 AED within 12 KMs from registered office, An additional AED 5 per km will be charged for any distance exceeding 12 km. ( This service is subject to request made by renter(
26. Returning the car after official timings mentioned in the agreement will be charged AED 350, not to bring the car for routine maintenance a weekly fine of AED 1,000.
27. When the vehicle is returned dirty and unclean, an amount of 525 AED for interior cleaning and AED 350 for exterior cleaning will be charged by the company.
28. PENALTY AED 525/- will be charged for smoking smell or smoking in the car while returning. Hirer must provide Car Washing Bill from ENOC/ EPCO/ EMARAT/ADNOC or Aed 350 dirhams will be charged.
29. Car must be returned with the same level of fuel while opening of the contract. Minimum AED 100 will be charged for each less point of the fuel.

ADD ONS

30. Any Additional Driver will be charged a minimum for 350 Dirhams (if the rent period is less than a month) or at AED 350 per month and it will be applicable even if the car is returned by other person than hirer.
31. Returning the car to another branch or non-branch location, where the contract not signed in, an amount of 350 AED will be charged.
32. Car Key Lost/ Damage charges are AED 1500 + cost of making a new key. These charges are applicable even for the unlocking and opening the car with duplicate key in any case.
33. Duplicate key will not be issued to the hirer, the company representative will only open the car and handover the belongings to the hirer, Current car must be taken back and hirer will be given a replacement car as rental company have to arrange a duplicate key before giving the car to new customer.
34. No information will be given or any payments will be made except to the renter himself.
35. The renter has the right to claim the deposit amount after 30 days of returning the car to the company by bank check.
36. Each Month will be counted as 30 days.
37. The renter has no right to collect the deposit after 1 year.
38. RCD Rent a car will charge AED 100+VAT as late payment charges per day for delaying the payment in any case from date of payment due till the date he paid and clear his balance.
39. The renter must pay his traffic fines within 3 days of registration with an administration fee of 105 AED for each traffic fine, but fines with black points must be paid within 48 hours of the fines registration, the renter will be fined 105 AED per day for delaying the payment of black point's fine.
40. The hirer takes full responsibility for the traffic violations of the black points that occurs during his rental period and the company has the right to transfer these black points and fines on hirer driving license of traffic file, whether the driving license is issued by UAE or it is an international license.
41. The hirer takes full responsibility in case of crossing red light specifically in the emirates of Abu Dhabi and all of its consequences, the Traffic and any other related fine, impounding fee and the amount of rent for the impounding period until the car is not received by the company and transfer of any black points, fines or any other charges to his driving license.
42. The hirer accepts full responsibility for the violations of exceeding the red light, including black point, traffic fines, impounding fee and all other charges associated for all the emirates in UAE.
43. In the event that the vehicle not be able to use because of accidents, repairs after an accident, police or court-held vehicle detention, or any action by the renter to stop the vehicle from use, the renter shall be bound by the daily rental value of the vehicle for the full entire period.
44. The renter is required to pay 100 AED or 10% of which is higher as an administrative fee on each traffic fine. Which is applicable even if the hirer is paying the fine by himself.
45. Admin Fee for each Toll Gate (Salik/Darb) is 2 AED i.e. minimum 6 Dirhams/trip
46. Admin Fees on any parking charges is 30% of the parking amount
47. If the driver passes the red traffic light, AED 200 will be charged daily as an administrative charge for the payment of the fine and the renter must pay the fine within 24 hours of the registration of it.
48. Renter is responsible for all damage and repairs to the vehicle during the rental period.
49. Any fines related to Original Mulkia (Car Registration Card) will be on Hirer
50. Hirer can take the original Mulkia (Registration card) by depositing additional AED 200/- A penalty for loss of the vehicle registration card is AED 400.
51. The renter must come to the company branch by himself and bring the original receipt of the deposit amount and the Emirates ID or the passport to receive the deposit amount otherwise he/she will not be able to receive it.
52. For the tourist renters, in case of leaving the country before the 30 days of returning the car finished, the company will transfer the deposit amount after the 30 days by WESTERN UNION or by bank transfer.

THE INSURANCE

53. The insurance remains in effect during the paid rent period and in the event of non-payment of rent by the renter the insurance will become null and void the falls and will not active, the renter will be responsible for the cost of repairing any damage to the vehicle, paying for any fines on the vehicle's ownership, paying the full price of the vehicle and paying full compensation to the company in the event of a total loss of the vehicle.
54. Tires and windscreens are not covered in any kind of insurance. Customer will bear all such charges and the rent for the days for which, the car will be in Garage.
55. The Hirer is Liable to pay Insurance Excess Amount, stated in the contract, depends on the car type starting from Minimum AED 2100 and maximum of 25000 + 30 % of the repair cost and spare parts as well as the daily rent until repair is completed in case of his/her fault or a damaged caused to the car by unknown party (if there is no liable party in Police Report) or in case of hirer's fault. This insurance excess is applicable for even minor scratch or small dent also.
56. The renter is required to pay Insurance Excess Amount + 40% of the price of the vehicle at the time of purchase in the event that the vehicle got total loss resulting from an accident that he/she is caused,
57. Customer is not allowed to repair the car in any case, in case of repair 'RCD Rent a car' reserves the right to charge AED 15000.
58. In case of purchasing SCDW at the start of the renting the car the insurance excess is NILL however if the car gets total loss minimum 40% of the car value at the time of purchase is payable by the hirer in case of his/her fault.
59. The value of Insurance Excess
60. Customer is Liable to pay the rent for the time car is in Garage and it is required to pay in all conditions.
61. The renter is obliged to pay insurance excess and the total amount of repairs after the accident if the driver is under 21 years old or if the renter's driving license is not more than one year old, and the renter therefore bears all the liability as described in previous articles
62. Insurance covers the vehicle only within the UAE

THE RENT VALUE

63. Rent must always be paid in advance.
64. In case customer fails to pay rent in advance company will charge rent as per listed price mentioned in schedule of charges.
65. Only the company is responsible for determining the rental value of the vehicle and is entitled to change, modify, increase and lack it as it deems appropriate.
66. When the contract duration finished, the price which mentioned in the contract will be changed based on the attached price list.
67. Any past, present and future discount is not applicable in any dispute, criminal or court case and rent will be consider on daily rate only.
68. The renter is not entitled to continue rent at the rate agreed upon in the contract after its termination and is not entitled to contest the company judicially for that.
69. Early return charge: Rent will be charge as per contract price and parking fee will be charges for the days car is returned early.
70. The contract value is payable in advance to the Company and if the renter wishes to extend the contract period, he/she shall be notifying the Company at least 48 hours before the contract expires and the renewal period shall be paid in advance to the Company.

LEGAL RESPONSIBILITY

71. The renter acknowledges that all personal information provided to the Company such as telephone number, home address, work address, email, Makani number of his or her place of business and home is correct and complete and that he or she is fully responsible for compensating the Company if he or she gives false data.
72. The Renter acknowledges that the Vehicle is insured only as per the terms and limits of the Company's insurance policy. Any loss, damage, or liability arising from events not covered by the insurance policy—including but not limited to natural disasters, Acts of God, war, civil unrest, or force majeure events—shall be the sole responsibility of the Renter. The Renter agrees to bear all associated costs, including repair, replacement, recovery, loss of use, and any applicable charges.
73. In the event that the renter drives the car under the influence of alcohol or drugs, or uses it in transporting prohibited or criminal substances, transporting passengers, or using it as a taxi (taxi), racing, speed challenges, any kind of car sports, or any acts contrary to public morals, criminal liability and the civil liability will be on the renter alone and he/she must bear all the costs of maintaining the car in the event that it is damaged, or pay the full price of it in the event of total loss with the compensation determined by the company for its financial and moral losses.
74. Incase customer fail to pay the rent of the car and return the car within 15 days, he is liable to pay the price of the car at the time of purchase and fines Salik and rent during his usage .
75. If the renter does not pay the rent within 24 hours, the company will take all criminal and civil proceedings against him/her.
76. The renter acknowledges and accepts, in the event of non-payment, that all DPS shall be competent to file a criminal case against him/her for refraining from payment crime as set out in article 395 of Federal Law No. 3 of 1987.
77. UAE courts have the authority to review any cases happen by this contract.
78. Three annexes are attached with this contract.
79. The renter acknowledges and accepts that the terms and conditions of this contract have been fully explained and understood and has no objections to the articles of this contract.
80. This contract has been written in two copies by each Party to use when necessary.
